SSDI Processing Times in Delaware Explained

Applying for Social Security Disability Insurance (SSDI) in Delaware is rarely a quick process. Most applicants wait months — sometimes years — before receiving a decision. Understanding the typical timeline at each stage of the process helps you set realistic expectations and take the right steps to protect your claim.

Initial Application: The First Hurdle

After you submit your SSDI application, the Social Security Administration (SSA) sends your file to Delaware's Disability Determination Services (DDS), which operates under the Delaware Division of Vocational Rehabilitation. DDS medical consultants and examiners review your medical records and work history to decide whether you meet SSA's definition of disability.

At the initial application stage, Delaware applicants typically wait three to six months for a decision. However, processing times fluctuate depending on case complexity, medical evidence availability, and DDS workload. Simple cases with complete, well-documented medical records move faster. Cases requiring consultative examinations — medical evaluations arranged and paid for by the SSA — take longer because scheduling those appointments adds weeks to the timeline.

Nationally, the SSA approves only about 20–25% of initial applications. Delaware's approval rate is consistent with that range. If your initial claim is denied, do not be discouraged. Denial at this stage is common and does not mean you lack a valid claim.

Reconsideration: A Second Review

If DDS denies your initial application, you have 60 days (plus a five-day mailing grace period) to request reconsideration. At this stage, a different DDS examiner reviews your file along with any new medical evidence you submit.

Reconsideration in Delaware typically takes an additional three to five months. Statistically, this stage has the lowest approval rate in the process — roughly 10–15% of reconsideration requests are approved. If reconsideration is denied, you can request a hearing before an Administrative Law Judge (ALJ). Delaware claimants are served by the SSA's hearing offices, including the Wilmington hearing office. Wait times at this stage have historically been the longest part of the entire process.

As of recent reporting, Delaware claimants waiting for an ALJ hearing face waits of 12 to 24 months or more after requesting a hearing, though SSA has made efforts to reduce backlogs. The ALJ hearing stage has the highest approval rate in the SSDI process. Nationwide, approximately 45–55% of ALJ hearings result in a fully favorable or partially favorable decision. Preparation matters enormously at this stage. You should:

  • Gather all updated medical records from every treating source
  • Obtain detailed opinion letters from your doctors describing your functional limitations
  • Review your work history carefully to identify all jobs you have held in the past 15 years
  • Consider working with a disability attorney who regularly appears before Delaware ALJs

Appeals Council and Federal Court

If the ALJ denies your claim, you can appeal to the SSA's Appeals Council, which reviews ALJ decisions for legal error. The Appeals Council does not hold a new hearing — it examines the written record. This stage adds another 12 to 18 months of waiting in many cases, and the Appeals Council denies review in the majority of cases. However, when it does grant review, it can reverse a denial or return the case to the ALJ with instructions for a new hearing.

The final avenue of appeal is filing a lawsuit in federal district court. In Delaware, that means the U.S. District Court for the District of Delaware in Wilmington. Federal litigation is complex, costly, and time-consuming, but it is sometimes the right path when an ALJ's decision reflects a significant legal or factual error that the Appeals Council ignored.

How to Avoid Unnecessary Delays

While some waiting is unavoidable, certain actions within your control can prevent additional delays that slow your claim down further.

  • Submit a complete application. Missing information, such as the names and addresses of all treating physicians or a list of all medications, causes DDS to send follow-up requests that extend processing time.
  • Respond promptly to all SSA correspondence. DDS and SSA send requests for additional information with deadlines. Missing those deadlines can result in a denial or dismissal of your claim.
  • Attend all scheduled appointments. If DDS schedules a consultative examination, you must attend. Failing to appear without a valid reason can result in denial.
  • Keep your contact information current. SSA cannot reach you if your address or phone number changes. Update your information immediately through your my Social Security account or by contacting your local SSA office.
  • Ask about expedited processing. SSA has programs that allow faster processing in limited circumstances, including Compassionate Allowances for certain severe diagnoses and TERI cases involving terminal illness. If your condition qualifies, ask SSA to flag your claim accordingly.
