How to Claim Insurance in an Accident: A Florida Property Damage Guide

An accident that damages your home or belongings is stressful. A kitchen fire, a burst pipe, a tree through the roof, or a vehicle crashing into your property can upend your life in minutes. Knowing how to claim insurance in an accident helps you protect your rights while you get your life back in order. The steps below are specific to Florida property damage claims.

Step 1: Protect Your Safety and Your Property

Your safety comes first. If there is a fire, flooding, or structural danger, get everyone out and call 911. Once the scene is safe, take reasonable steps to prevent further damage. Your policy requires this, and the insurer may refuse to pay for damage that gets worse because you did nothing.

Reasonable steps include:

  • Covering a damaged roof with a tarp
  • Boarding up broken windows or doors
  • Shutting off the water at the main valve
  • Moving undamaged belongings to a dry, safe place

Keep every receipt for emergency repairs. These costs are usually reimbursable under your policy.

Step 2: Document Everything Before You Clean Up

Evidence is the foundation of a strong claim. Before you repair or discard anything, record the damage thoroughly:

  • Photos and video. Capture wide shots of each room or area, then close-ups of the damage. Narrate the video with the date and what you are showing.
  • A written inventory. List each damaged item with its age, brand, purchase price, and replacement cost. Receipts, bank statements, and old photos help prove ownership and value.
  • Police or fire reports. If the accident involved another driver, a fire, or a crime, get the report number.
  • Other people's information. If a third party caused the damage, collect their name, contact details, and insurance information. Get witness contact information too.

Keep damaged items until the adjuster has seen them, unless they are hazardous. Store everything in one folder, digital or physical.

Step 3: Report the Claim to Your Insurance Company in Writing

Call your insurer or use its app to report the loss as soon as you can. Then follow up in writing, by email or certified mail, so you have a dated record. Include the date of the accident, what happened, the damage you have found, and the policy number.

Florida law sets a strict deadline. Under Florida Statute 627.70132, you generally must give notice of an initial property claim within one year of the date of loss. For a supplemental claim, which covers additional damage found after the first payment, the deadline is generally 18 months. Do not wait. Delay lets evidence disappear and gives the insurer a reason to dispute the claim.

Write down the claim number, the name of everyone you speak with, and the date of each call.

What Florida Law Requires Your Insurer to Do

Florida sets deadlines for insurance companies too. Under Florida Statute 627.70131, your insurer generally must:

  • Acknowledge your claim within 7 days of receiving notice.
  • Begin its investigation within 7 days after receiving a proof of loss statement.
  • Complete a physical inspection within 30 days of receiving the proof of loss, if one is needed.
  • Pay or deny the claim, in whole or in part, within 60 days of receiving notice, unless factors beyond its control prevent it.

If the insurer misses these deadlines, that may be a violation, and it can strengthen your position. Keep a calendar of the dates so you can show exactly when each step was due.

If an adjuster is assigned, be present for the inspection. Walk through the damage room by room, point out everything you documented, and ask for a copy of the adjuster's estimate.

Mistakes That Can Shrink Your Claim

Many Florida homeowners lose money on valid claims because of avoidable errors:

  1. Accepting the first offer without review. The first estimate often leaves out hidden damage, code upgrades, or the true cost of materials and labor. Compare it with a contractor's itemized estimate.
  2. Giving a recorded statement without preparing. You are required to cooperate, but you do not have to guess or speculate. Stick to facts you know.
  3. Starting permanent repairs too early. Emergency repairs are fine. Permanent repairs before the insurer inspects can give it grounds to dispute the damage.
  4. Signing documents you have not read. Releases, proof of loss forms, and assignment of benefits paperwork can limit your rights.
  5. Missing deadlines. Missing the notice deadline, or ignoring a request for documents, can put your whole claim at risk.

If the insurer asks for a sworn proof of loss, read it carefully before signing. An incomplete or inaccurate form can hurt you later.

What to Do If Your Claim Is Denied or Underpaid

A denial or low payment is not the end of the road. Start by asking for the decision in writing, along with the specific policy language the insurer relied on. Florida insurers must give a reasonable explanation for a denial or partial denial.

Then take these steps:

  • Request your complete claim file and a copy of your policy.
  • Get a second opinion. A licensed contractor, public adjuster, or engineer can document damage the insurer missed.
  • Submit a written rebuttal with your evidence and a clear request for reconsideration.
  • Consider mediation. Florida's Department of Financial Services offers a free mediation program for residential property disputes.
  • Talk to a property insurance attorney before time runs out. Legal deadlines for filing a lawsuit are limited, and waiting can cost you the right to recover.

Insurers have teams of adjusters and lawyers working to limit what they pay. You are entitled to the same level of support. At Louis Law Group, we review denial letters, adjuster estimates, and policy language to find where the insurer got it wrong, and we handle the fight so you can focus on rebuilding.
