You browse a website, add a few items to your cart, and close the tab. You assume that visit was private. Often, it wasn't. Hidden software on many sites records what you click, what you type, and where you go, then sends that information to outside companies. If that sounds invasive, California law agrees. It is the reason CIPA lawsuits in California have become one of the most active areas of consumer privacy litigation.

This guide explains the law in plain English, what you could recover, and what to do next.

What Is CIPA, and Why Are CIPA Lawsuits in California Increasing?

The California Invasion of Privacy Act (CIPA) is a state law, found in Penal Code sections 630 and following, that was passed in 1967. It was written to stop secret wiretapping and eavesdropping on phone calls. Its language is broad, and today's lawyers and courts apply it to the internet.

Three parts of the law matter most for online shoppers:

  • Section 631 bars anyone from reading or learning the contents of your communications without everyone's consent. Plaintiffs argue that tracking tools, chat widgets, and session-replay software do exactly that.
  • Section 632.7 covers recording or intercepting communications involving cellular and cordless phones.
  • Section 638.51 restricts "pen register" and "trap and trace" devices, which capture identifying information such as IP addresses. Plaintiffs argue some website trackers fit this description.

CIPA lawsuits have multiplied because the law gives people a private right to sue and sets a fixed dollar amount per violation. You generally do not have to prove you lost money.

What Website Activity Can Violate CIPA?

Most claims involve technology you cannot see. Common examples include:

  • Session replay software, which records your mouse movements, clicks, scrolling, and keystrokes, almost like a video of your visit.
  • Tracking pixels and third-party scripts that send your browsing behavior, device details, or IP address to advertising and data companies.
  • Chat tools that record your messages and share them with a third-party vendor.
  • Form capture, where information you type is collected before you ever click "submit."

The central legal question is consent. A small cookie banner, or a privacy policy buried in a footer link, may not amount to real agreement. If a company collected or shared your data without clearly telling you first, that can be the basis for a claim.

Courts have not all reached the same conclusions about these tracking tools, and outcomes depend heavily on the facts of each site. That is why having your situation reviewed individually matters.

How Much Can You Recover in a CIPA Claim?

Under Penal Code section 637.2, a person whose rights were violated can recover the greater of $5,000 per violation or three times their actual damages. They can also seek an injunction ordering the company to stop the practice.

Two points to understand:

  1. You do not need to show financial harm. The statute sets the damages amount, which is why these cases can proceed even when no money was stolen.
  2. Most cases are brought on behalf of many people. When thousands of shoppers had their data collected the same way, claims are often combined into a class action or handled through coordinated individual filings. What each person actually receives depends on the outcome of the case, whether by settlement or judgment, and no result can be guaranteed.

Can You File a CIPA Claim If You Don't Live in California?

Possibly. Many of these cases are not limited to California residents, so people nationwide ask this question. Whether CIPA applies often turns on where you were when you used the site, where the company is based, and where its tracking operated. Some visitors from other states may also have claims under their own state wiretapping or privacy laws.

Because the answer is specific to your facts, do not assume you are excluded. A short review can tell you quickly. If you think you may have a claim, you can see if you qualify in a few minutes.

What Should You Do If You Think Your Data Was Collected?

If you shopped on a website and suspect your activity was tracked without clear permission, take these steps now:

  • Write down the details. Note the website, the approximate dates you visited, and whether you bought anything or typed personal information.
  • Save your records. Keep order confirmations, receipts, account emails, and screenshots of any cookie banner or privacy notice you remember.
  • Do not delete your account or emails. They can help show that you were a real visitor.
  • Avoid contacting the company yourself about a possible claim. Doing so can complicate your options.
  • Act promptly. Legal claims have deadlines. In California, the time limit for many privacy claims can be as short as one year, depending on the claim, so waiting can cost you the right to recover.

It is normal to feel uneasy about learning that something as ordinary as online shopping exposed your personal information. You did nothing wrong, and the law exists to hold companies accountable for how they handle your data.
