Background: A Fatal Crash in Polk County

According to Insurance Journal, a 10th-grade girl and a motorist were killed Monday morning when a car hit a school bus full of high school students in central Florida, causing the bus to swerve and overturn.

Polk County Sheriff Grady Judd said at a news conference that video of the crash exists and is being studied by investigators. In the footage, a white sedan veers across the center line on Lucerne Park Road and hits the rear wheel of the bus, tearing off a tire. The bus then appeared to fishtail and strike a Jeep head-on. The Jeep caught fire, killing one person inside.

Several people were taken to hospitals, some with serious injuries. The bus was carrying 37 students to Winter Haven High School. It was not clear why the white vehicle crossed the center line. The driver is cooperating with investigators, according to the Associated Press. Sheriff Judd called it the worst bus tragedy in the area in decades. The names of the deceased and injured had not been released as of Tuesday.

This article discusses general insurance and claims principles only. The investigation is ongoing, and no determination of fault has been reported.

Why Multi-Vehicle Crashes Raise Complex Claims Issues

A collision involving a school bus, a passenger car and a second vehicle can involve several overlapping insurance and legal questions.

Multiple coverages

  • Auto liability: The at-fault party's liability coverage may respond to bodily injury and property damage claims. Policy limits can be a significant constraint in a crash with several injured people.
  • Personal Injury Protection (PIP): Florida's no-fault system generally provides initial medical and disability benefits to occupants regardless of fault, subject to policy terms and statutory limits.
  • Uninsured/underinsured motorist coverage: Where available, it may supplement recoveries if liability limits are insufficient.
  • Collision and comprehensive: First-party coverage may address damage to the Jeep, including fire damage, depending on the policy.

Government entity considerations

School buses are typically operated by public school districts. Claims against Florida governmental entities are subject to the sovereign immunity waiver statute, section 768.28, which includes pre-suit notice requirements and statutory caps on damages. Claimants and their representatives should confirm the current requirements and deadlines promptly, because missing a notice requirement can jeopardize a claim.

Evidence preservation

Video, vehicle event data, crash reports, inspection records and witness statements can all affect how fault is allocated. Florida applies comparative fault principles, so evidence about each party's conduct matters. Vehicles, particularly after a fire, should not be repaired or disposed of until the relevant parties have had a chance to inspect them.

Property Damage Angles for Adjusters

Although the human toll is the priority, vehicle and property damage claims arise in every serious collision.

  • Total loss evaluation: A vehicle destroyed by fire is likely to be evaluated as a total loss. Valuation disputes over comparable vehicles, options and condition are common.
  • Fire cause and origin: If a fire follows a collision, carriers may investigate how it started. Documentation matters for both first-party claims and subrogation.
  • Roadway and third-party property: Crashes can damage guardrails, signage, landscaping and adjacent structures, which may generate separate property claims.
  • Subrogation: A carrier that pays its insured may seek reimbursement from the responsible party's insurer, so early evidence preservation helps.

Practical Takeaways

  • Act on notice deadlines early. Claims involving public entities have special notice rules, and PIP benefits have their own time requirements.
  • Request and preserve records. Ask for the crash report and any available video, and preserve photographs, repair estimates and medical records.
  • Avoid recorded statements without guidance. Injured people and families should consider speaking with counsel before giving recorded statements to any insurer.
  • Review all potentially applicable policies. Auto, umbrella, health and employer-provided coverages may all play a role.
  • Be sensitive. Families dealing with a death or serious injury need patient, respectful communication from every professional involved.
