Background: A Fatal Attack in Winter Garden

On Friday, October 16, 2026, a 71-year-old man fishing from the shore of Lake Apopka was killed by a nearly 12-foot alligator. Steven Hamilton of Winter Garden was at Dr. Bradford Memorial Park, about 15 miles northwest of Orlando, when the attack occurred around 5 p.m., according to the Winter Garden Police Department.

Other active alligators in the water complicated any rescue attempt. Mr. Hamilton's body was recovered about two hours later. Police Capt. Michael Mason said authorities were not alerted in advance that an alligator was near the shore, possibly because the lake "has tons of alligators in it." Police launched a joint investigation with the Florida Fish & Wildlife Conservation Commission, whose trappers captured and killed the alligator.

A Second Fatality This Year

This was the second fatal alligator attack reported in 2026. In June, 31-year-old Brittany Clark of Oviedo was killed by a 13-foot alligator near her home. Following that incident, U.S. Rep. Greg Steube introduced a resolution calling for the Comptroller General and the U.S. Department of the Interior to study how the American alligator's federal listing as "threatened due to similarity of appearance" affects Florida's ability to remove nuisance alligators from residential and commercial waterways. Steube said the species has been fully recovered since 1987 but remains protected to prevent trafficking and hunting of the similar-looking American crocodile.

Using Florida state data, the two 2026 deaths bring the total number of people killed by alligators in Florida since 1948 to 34.

Why This Matters to Insurance Professionals

This is primarily a public safety story, and nothing in the reporting addresses insurance coverage or litigation. It does highlight risk categories that PAs, adjusters, and policyholders encounter around Florida's waterways.

Premises and Property Liability

Florida homes and commercial properties often sit on or near ponds, canals, and lakes. Questions about duty, warnings, and control of the property can arise after a wildlife incident, and the answers depend heavily on the facts, including who owns or controls the land. This article does not suggest how any such claim would be decided. Parties should seek individualized legal advice.

Homeowners Liability Coverage

Homeowners policies commonly include personal liability coverage, but terms, exclusions, and limits differ by carrier and policy form. Policyholders with waterfront property should know what their liability limits are and whether any endorsements or exclusions affect them.

Documentation After an Incident

When a serious incident occurs on or near insured property, prompt documentation helps. Useful records include photographs, incident reports, witness information, and any communications with law enforcement or wildlife officials.

Practical Takeaways

  1. Review liability limits and exclusions on waterfront properties.
  2. Report any serious incident to the carrier promptly and in writing, following policy notice provisions.
  3. Preserve evidence and obtain the official incident report numbers.
  4. Remind clients that authorities advise people to keep their distance from wildlife. As Capt. Mason said, an alligator may look docile, but it can be dangerous.
